Publication of the Occupational Health and Safety Amendment Bill 2020

The Minister of Employment and Labour recently published a notice of his intention to present the Occupational Health and Safety Amendment Bill, 2020 to the National Assembly.

 

The bill seeks to amend the OHS Act, 1993 (Act 85 of 1993) and align it to international trends. It also seeks to strengthen the safety measures of workers in their respective workplaces.

 

The Bill further seeks to amend the Act so as to:

  • delete, substitute and insert certain definitions;
  • effect certain technical corrections;
  • further provision in respect of the health and safety of persons at work and for the health and safety of persons in connection with the use of plant and machinery;
  • further regulate the protection of persons other than persons at work against hazards to health and safety arising out of or in connection with the activities of persons at work;
  • further regulate the composition of an advisory council for occupational health and safety

Although the OHS Bill 2020 will not be an entirely new Act, and only amendments of the existing OHS Act, there will be substantial changes that will affect all employers. Awaiting further developments in this regard.
